These Terms of Service (“Terms”) govern your access to and use of www.compartmento.com.au (the “Site”) and any purchase of products from Compartmento (“we”, “us”, “our”). By accessing the Site or placing an order, you agree to these Terms. If you do not agree, do not use the Site. You must be able to form a legally binding contract under Australian law to use the Site and purchase products. You agree to provide accurate, current information when placing an order and to use the Site lawfully. We try to ensure product descriptions, images, colours, specifications, and pricing are accurate. However, product images are for illustration only and may vary depending on device/display settings, photography lighting, and environmental conditions, and to the extent permitted by law, we may correct errors (including pricing/availability errors) and update information without notice. All prices are in AUD unless stated otherwise and include GST where applicable. Shipping costs are shown at checkout unless otherwise stated. We may change prices at any time, but changes will not affect orders that have already been accepted and paid. Submitting an order is an offer to purchase. An order is only accepted when we confirm acceptance (for example, dispatch confirmation) and/or process payment and allocate stock for dispatch. We may refuse or cancel an order where permitted by law, including for suspected fraud, stock limitations, pricing errors, or delivery restrictions. If we cancel an order after payment, we will refund you to the original payment method. Payments are processed by third-party payment providers. You authorise us and our payment providers to charge the payment method you provide for the total amount shown at checkout (including shipping and taxes). We do not store full payment card details (these are handled by the payment provider). Title (ownership) in the goods does not pass to you until we have received full payment of all amounts payable in respect of your order (including shipping charges where applicable). Delivery timeframes are estimates only and may vary. To the extent permitted by law, we are not liable for delays outside our reasonable control (for example, carrier delays or weather events), and risk in the goods passes to you when the goods are delivered to the delivery address provided in your order (or collected, if applicable). You are responsible for ensuring delivery details are correct. If an order is returned due to an incorrect address or failed delivery, additional shipping charges may apply to resend. Our Refunds & Returns Policy forms part of these Terms and applies to all purchases. Where there is any inconsistency, the Refunds & Returns Policy will apply for returns and refunds processes. Nothing in these Terms limits your rights under the Australian Consumer Law. Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have goods repaired or replaced if goods fail to be of acceptable quality and the failure does not amount to a major failure. If we offer promotions or discount codes, they apply only as stated, for the period stated, and while stocks last, they cannot be exchanged for cash, and we may cancel or modify promotions where permitted by law (including where misuse is suspected). If store credit is offered, it is non-transferable and cannot be redeemed for cash unless required by law. All content on the Site (including product designs, text, graphics, logos, images, video, and software) is owned by or licensed to Compartmento PTY LTD and protected by intellectual property laws. You may not copy, reproduce, modify, distribute, or exploit Site content without our prior written consent. If you submit reviews, photos, or other content (“User Content”), you confirm you have the right to submit it and grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce, publish, and display the User Content for marketing and site operation purposes. We may remove User Content at our discretion (for example, if it is misleading, unlawful, or offensive). You must not misuse the Site (including by introducing malware, scraping, hacking, or interfering with security), attempt unauthorised access to accounts or systems, use the Site for unlawful, misleading, or fraudulent purposes, or infringe any third-party rights. The Site may integrate third-party services (for example, Shopify, payment providers, shipping carriers, analytics tools) and may contain links to third-party websites. We are not responsible for third-party services or websites, and your use of them may be subject to their terms and policies. Our Privacy Policy explains how we handle personal information. By using the Site, you acknowledge our Privacy Policy. To the extent permitted by law, we are not liable for any delay or failure to perform our obligations under these Terms if the delay or failure is caused by events beyond our reasonable control (“Force Majeure Event”), including without limitation natural disasters, fire, flood, storms, pandemics, war, terrorism, civil unrest, government actions, labour disruptions, supply chain interruptions, carrier or port delays, power or internet outages, and failures of third-party platforms or service providers. Where a Force Majeure Event occurs, we will take reasonable steps to minimise the impact and resume performance as soon as practicable. To the extent permitted by law, the Site and its content are provided “as is” and “as available.” We do not warrant that the Site will be uninterrupted or error-free. To the extent permitted by law, we exclude liability for indirect or consequential loss (such as loss of profit, revenue, data, or business opportunity), and our liability for loss or damage arising from your purchase or use of the Site is limited to, at our option, resupplying the goods/services or paying the cost of resupply, except where the Australian Consumer Law requires otherwise. Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy under the Australian Consumer Law that cannot be excluded. You agree to indemnify us for any loss, claim, liability, or expense (including reasonable legal costs) arising from your breach of these Terms, your misuse of the Site, or your violation of any law or third-party rights. We may update these Terms from time to time. The updated version will be posted on the Site with a new “Last updated” date. Your continued use of the Site after changes take effect constitutes acceptance of the updated Terms. These Terms are governed by the laws of New South Wales, Australia.
